Introduction

These Referral Program Terms supplement the Terms of Service and apply if you participate in the Playboy Club Referral Program. By participating, you agree to these Referral Program Terms, which form part of your agreement with us.

Key Points to Know:

• You must comply with our Terms of Service, all applicable laws, and any relevant tax regulations.

• You must have an active User account to participate in the Playboy Club Referral Program.

• Referring Users will receive a referral payment equal to (1) 5% of Fan Payments generated by the Referred Creator, and (2) 5% of Fan Payments of at least $1 made by the Referred Fan to a Creator other than the Referring User.

• We may withhold referral payments or suspend participation if a Referred User breaches the Terms of Service.

• The Playboy Club Referral Program is managed by ENDsun Services, LLC, a Delaware limited liability company with its principal place of business at 4801 Gulf Blvd., Suite 193, St. Pete Beach, Florida 33706.

Definitions

In these Referral Program Terms, defined terms have the same meanings given to them in the Terms of Service. In addition, the following definitions apply:

“Referred Creator” means the person who joins Playboy Club as a new Creator through the Referring User’s unique referral link.

“Referred Fan” means the person who joins Playboy Club as a new Fan through the Referring User’s unique referral link.

“Referred User” means a Referred Creator or a Referred Fan or both.

“Referring User” means “you” or “your.”

Playboy Club Referral Program

Playboy Club offers a referral program (the “Playboy Club Referral Program” or the “Referral Program”) by which existing Creators can introduce new users to Playboy Club as Creators or Fans and receive referral payments in accordance with these Referral Program Terms.

Referral Program Rules

1. Users may participate in the Referral Program if their Playboy Club account is active and in good standing. If we have suspended or terminated a User’s account for any reason or the User has deleted their account, that User is ineligible for the Referral Program.
2. You must provide a valid bank account or other payment details to receive referral payments under the Playboy Club Referral Program.
3. Each User receives a unique referral link that may be shared with others. When doing so, the User must not impersonate Playboy Club or suggest that Playboy Club endorses or promotes the referral. Referral links must not be shared using paid search advertising platforms such as Google Ads. Upon request, Users must disclose how they are sharing their referral links.
4. When promoting Playboy Club using your referral link, you must clearly and conspicuously disclose your financial relationship with Playboy Club (e.g., “I receive a commission if you sign up using my link”). You must not make any false or misleading statements about Playboy Club, including but not limited to earnings potential or platform features. You are solely responsible for ensuring that your promotions comply with the FTC Endorsement Guidelines and all applicable advertising laws.
5. You must not share referral links in a way that targets or is likely to be accessed by individuals under the age of 18, or in any manner that violates content standards under applicable laws, including the UK Online Safety Act 2023.
6. If you promote Playboy Club in the European Union, you must comply with all applicable provisions of the Digital Services Act (DSA), including obligations to avoid promoting illegal content, to label advertising clearly, and to act responsibly in online environments.
7. The Referred User must click your unique referral link and complete registration with Playboy Club in the same browser session. We use cookies to recognize you and the Referred User for referral tracking purposes. If the Referred User registers without using your referral link, or if either of you disables, blocks, or declines the necessary cookies, we will be unable to track the referral and no referral payments will be made. Clearing or blocking cookies may also prevent us from attributing the referral to you. Tracking cookies used for referral attribution may involve the processing of personal data. For more information, including your rights and options, please see our Privacy Policy and Cookie Policy. In the EU/UK, referral tracking may be impacted by your cookie consent settings.
8. We process referral tracking data based on your consent, where required by applicable law. In jurisdictions requiring prior consent for the placement of cookies (including the EU/UK), referral tracking cookies will only be set after you provide consent through our cookie banner.
9. If a Referred User creates more than one User account using your referral link, referral payments will only be made based on Fan Payments generated through the first account that the Referred User registers. You will not receive referral payments on any additional accounts the Referred User may create, even if those accounts were also created using your referral link.
10. No referral payments will be made to you based on earnings in any account that we determine is owned or operated by you, or by a Referred User with whom you have a commercial relationship. You must provide any information we request to help us determine whether a Referred User’s account is ineligible for referral payments for this reason.
11. When promoting Playboy Club, Referring Users must not give a false impression of Playboy Club or make earnings guarantees to potential Creators.
12. A Referred User may opt out of the Referral Program at any time for any reason. If a Referred User withdraws from the Referral Program, no further referral payments will be made to the Referring User.

Referral Payments

1. Once a Referred User establishes an account, the Referring User will be paid a referral payment for each Referred User as follows:
1. 5% of Fan Payments generated by the Referred Creator; and
2. 5% of Fan Payments of at least $1 made by the Referred Fan to a Creator other than the Referring User.
2. All referral payments are inclusive of any applicable Indirect Sales Tax that may apply under local law.
3. To receive referral payments, you must select a payout method supported by Playboy Club in your country of residence.
4. Referral payments that accrue during a calendar month will be paid to you on or around the first day of the following calendar month.
5. We bear the cost of referral payments; Referred Users are not charged any fee in connection with these payments.
6. Referral earnings may be subject to tax reporting obligations depending on your location. For example, this may include IRS Form 1099-MISC (U.S.), EU DAC7 reporting, or HMRC reporting obligations (UK). You are solely responsible for reporting and paying any taxes due on referral earnings.

Our Rights Relating to the Referral Program

1. We may require you or a Referred User to provide identification or other information reasonably necessary to verify your eligibility for referral payments and to confirm the appropriate recipient. If you fail to provide the requested information, you may forfeit your right to referral payments in connection with the relevant Referred User.
2. Playboy Club may modify any aspect of the Referral Program at any time, including how referral payments are calculated, or may discontinue the program entirely. However, no changes will affect referral payments already earned based on Fan Payments made to Referred Users before the effective date of the change.

When We May Withhold Referral Payments

The provisions in the Terms of Service that govern the withholding or forfeiture of unpaid Creator Earnings also apply to unpaid referral payments. If you believe a referral payment has been incorrectly withheld or denied, you may submit a complaint through our Appeals Policy or by contacting support@playboyclub.com We will review and respond to your complaint within 30 days. If the matter is not resolved to your satisfaction, you may pursue mediation as described in our Platform to Business Regulation Terms .

Compliance with Laws

By participating in the Referral Program, you agree to comply with all applicable laws, regulations, and platform policies, including but not limited to advertising laws, data privacy laws, the FTC Endorsement Guides, the UK Online Safety Act 2023, and the EU Digital Services Act (Regulation (EU) 2022/2065), as applicable.
